The more you narrow your search, the better your brand’s chances of succeed in the registration process. Being conservative when narrowing down your search is crucial. In addition to classifying your products / goods / services in the correct category (s).

When we review your application, we will look for trademarks that may cause confusion with your brand and choose the right category for your good and services.

1. Quick USPTO Database Search. This is included in our GOLD and EXPEDITED packages and consist on a basic and quick search in the USPTO Database to look if there is a direct conflict with an existing trademark. This does not include the Viability Assessment.
2. Complex Global Search (RECOMMENDED). Included in our PLATINUM and DIAMOND packages. We will search the federal and global database and inform you if there is an equal or similar trademark in another country. In addition, we do a complementary search in social networks and the Internet. Finally, we will send you a Viability Assessment based on our search.

An office action is an official letter sent by the USPTO. In it, an examining attorney may require that you fix legal problems with the application itself (requirements) by making simple revisions, such as clarifying your goods or services. An examining attorney may also raise legal rejections (refusals), such as refusing your application because your chosen trademark is likely to be confused with an already registered trademark. All legal problems must be resolved in the office action before the USPTO can register your trademark.

Statement of Use (SOU) / Amendment to Allege Use (AOU)

An Intent-To-Use trademark application allows an applicant to apply for a trademark that has not yet been used in commerce. Also, this application does not require any evidence of trademark use at the initial filing.

Still, if you file your trademark based on Intent-to-use (section 1b), you must file an allegation of use form (statement of use/amendment to allege use) and pay the required Federal Fee before a registration may issue. This subsequent submission of trademark usage has two different names; “Amendment to Allege Use” or “Statement of Use”, depending upon the timing of its filing.

USPTO Required Fee: $100 per class.

From the time your USPTO Trademark Application is approved you have 6 months to submit a Statement of Use / Allegation of Use.  If you have not begun to use the trademark you can request an extension of time.

An Extension Request is a sworn statement that the applicant still has a bona fide intention to use the mark in commerce, but needs additional time actually to use the mark.

USPTO filing fee of $125 per class of goods/services must be paid with the Extension Request.

We can file the required maintenance documents on time for you.

Once you have your registered trademark, you must timely file all required maintenance documents and continue to use the trademark in commerce with the goods and /or services in the registration in order to keep a federal trademark registration alive. Failure to file required maintenance documents will result in the registration being cancelled or expired by the USPTO.

Between the 5^th and 6^th year of registration, you must file a Section 8 declaration.  This is a signed statement filed by the trademark owner that the trademark is in use in commerce with the goods or services listed in the registration.

USPTO Fee for filing a Section 8 declaration is $225 per class.

Keep your TM alive!

Between the 9^th and 10^th year after registration, you must file a combined declaration of use and/or excusable nonuse and application for renewal under Sections 8 and 9 (combined filing). A Section 9 renewal application is a written request to keep your registration active.
